Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Karst Inspection, a Texas-based business ("Karst," "we," "us"), governing your use of the Karst Inspection mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.
1. Eligibility
The App is a professional tool intended for business use by adults. You must be at least 18 years old and able to form a binding contract to use it.
2. Your account
You need an account to use the App. You're responsible for keeping your login credentials secure and for activity under your account. Notify us at support@karstinspection.com if you believe your account has been compromised.
3. Subscriptions, free trial, and billing
- Free trial. New accounts may receive a 7-day free trial with full features. If you don't subscribe before the trial ends, paid features are locked, but you keep access to view and export your existing content (see Section 5).
- Subscription. Continued use of paid features requires an active subscription. Subscriptions are offered on the terms and at the prices shown in the App at the time of purchase.
- Billing and auto-renewal. Purchases and renewals are processed by Google Play (and, in future, the Apple App Store), not by us. Subscriptions auto-renew until cancelled. Manage or cancel your subscription in your app-store account settings; cancellation takes effect at the end of the current billing period.
- Refunds. Refunds are governed by the policies of the app store through which you purchased. We don't separately process payments and generally can't issue refunds directly.
- Price changes. We may change subscription prices going forward; we'll give notice as required by the app store and applicable law, and changes won't affect the period you've already paid for.
4. License to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your professional inspection work. You may not copy, modify, reverse-engineer, decompile, resell, sublicense, or attempt to extract source code from the App, except to the extent the law expressly permits.
5. Your content, and your responsibility to back it up
You own your content. The photos, voice notes, locations, observations, boundaries, plans, and reports you create ("Your Content") belong to you. Karst claims no ownership of Your Content.
Your Content lives on your device, not with us. As described in our Privacy Policy, Your Content is stored on your device and is not transmitted to, stored by, or accessible to Karst. We do not keep a copy and cannot recover Your Content for you.
Backup is your responsibility. Because Your Content is local to your device, you are solely responsible for backing it up using the App's export/backup features and your own storage. Loss, damage, theft, reset, or replacement of your device, or uninstalling the App, can permanently destroy Your Content. To the fullest extent permitted by law, Karst is not liable for any loss of Your Content. We strongly encourage you to set up and maintain off-device backups.
Access if your subscription lapses. If your subscription lapses, you retain the ability to open the App and view and export your existing content; an active subscription is required to create new work (new projects, captures, and generated reports).
6. The App is a tool; professional judgment is yours
The App helps you capture and organize field observations and assemble them into a draft report. It does not provide engineering, legal, or other professional advice, and it does not verify or guarantee the accuracy, completeness, or adequacy of any inspection, finding, measurement, location, or report. You are the professional. You are solely responsible for your inspections, your professional judgment, the content and conclusions of your reports, and your compliance with all laws, codes, standards, and licensing requirements applicable to your work. Any report generated by the App is a draft for you to review, complete, and stand behind before delivering it to anyone.
7. Acceptable use
You agree not to use the App to violate any law, infringe anyone's rights, or interfere with or disrupt the App or its providers. You agree not to misuse the account/authentication system or attempt to access another user's account or data.
8. Intellectual property
The App, its software, design, branding (including the KARST and Karst Inspection names and logos), and all related intellectual property are owned by Karst or its licensors and are protected by law. These Terms grant you no rights in them except the limited license in Section 4.
9. Third-party services
The App relies on third-party services (for example, Google Play billing, Google Firebase, Google Maps, and RevenueCat). Your use of those services may be subject to their own terms, and we're not responsible for third-party services.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS, OR THAT DATA (INCLUDING LOCATION DATA) WILL BE ACCURATE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KARST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. KARST'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold Karst harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the App, Your Content, your inspections and reports, or your violation of these Terms or applicable law.
13. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the App. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, governing law) survive.
14. Changes to these Terms
We may update these Terms from time to time. We'll post the updated version with a new effective date, and for material changes we'll provide notice through the App or by email. Continued use after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
